Services provided by the operator include (1) the rental and/or use of the electric vehicles it operates (in possession or rental) (“vehicle” or “vehicle”) and (2) any other equipment, support, services and related information provided or made available by the operator (together “services”). If a tenant feels that the landlord is in breach of a rental agreement, they should contact the landlord to remedy it. It is a good idea to communicate in writing to document the situation in case it is necessary to take the matter to court. A tenant has the right to file a civil action against a landlord in violation of his tenancy agreement. 9.2 Arbitration If the parties fail to reach a solution agreed by the support procedure, then each party can obtain arbitration to resolve claims, subject to the conditions listed below, unless the binding local law provides for something else. In particular, all claims arising from the use and rental of a vehicle, this agreement and the relationship between the parties are settled definitively by an arbitration procedure managed by the Belgian Centre for Arbitration and Mediation (CEPANI) or, failing that, by an arbitration or arbitration service agreed by mutual agreement, in accordance with the applicable rules of CEPANI or the arbitration service agreed by mutual agreement, with the exception of rules or procedures governing or authorizing the conditions. The terms of the tenancy agreement cover the details of the landlord-tenant contract, including data and dollar amounts. The general rental conditions are: 1.5 hours of operation for vehicles and vehicle availability. The driver accepts and acknowledges that vehicles may not be available 24 hours a day, 7 days a week, 365 days a year. Vehicles must be leased during operating hours and within the maximum rental time frames shown below. The number of vehicles is limited and the availability of the vehicle is never guaranteed. The driver accepts that the driver may at any time demand the return of a vehicle. A pre-printed lease form, usually available in office supply stores, is generally well suited to leases.
These forms are of a fundamental nature, so that a lot of information can be filled out by the parties to the lease themselves. Even a prefabricated lease is a legal contract, so it is important for the parties to read carefully to ensure that the provisions meet their needs.
